Article „Hidden Threats of Home Office“ by Elin Uusväli and Epp Lumiste
Newsletter of the business daily Äripäev on 9 December 2016 published the article „Hidden Threats of Home Office“ by attorney Elin Uusväli and attorney-at-law Epp Lumiste.
With regard to the changes taking place in the society and development of IT solutions, traditional work relations are also changing, including the requirements set by employees to employers. Upon choosing jobs, more and more employees prefer flexibility and possibility to work at home, if necessary. Considering the development of smart devices it is no longer essential to work in the office. However, although home office may appear tempting, there are various tax related risks to be considered.
To summarize the article, prior to making an agreement for teleworking, an employee should carefully consider the risks of working at home office, and be convinced that the conveniences of teleworking overweigh possible related tax risks. If employer and employee have already agreed on teleworking, it is necessary to consider that such work relation is to large extent unregulated by law and mainly the issue of mutual agreement. Therefore, in order to avoid possible disputes and inconveniences, the conditions of teleworking should be specifically regulated (including the division of costs that are related to teleworking and compensation thereof by the employer).
