Pirkka-Marja Põldvere and Marko Pilv successfully represented Estonian Tennis Association in sports arbitration
Estonian Tennis Association (ETA) appealed twice the decisions of the ITF Davis Cup Committee that had ruled that it was possible and practicable for the Estonian Davis Cup team to travel to Iran for the Davis Cup World Group II Play-off tie between Iran and Estonia. In both cases the arbitral tribunal ruled in favour of ETA, and thus the Davis Cup Committee had to decide the matter anew. Finally, upon deciding on the same issue for the third time, the committee satisfied ETA’s request to change the venue of the play-off tie. The tie is now scheduled to take place in Sri Lanka. Upon appealing the decisions of the ITF Davis Cup Committee, ETA was represented by Pirkka-Marja Põldvere and Marko Pilv, attorneys-at-law of LEADELL Pilv Law Office, Estonia.
ETA had brought out in its request to ITF that Iran is not a safe place to host the play-off tie due to severe security risks. ETA relied on the warnings of various democratic governments (including the United Kingdom, the United States of America, Canada, Australia, Germany, France, Finland and Estonia) – all of which advised against travelling to the Islamic Republic of Iran due to security risks. ETA also indicated that it had contacted the Estonian Ministry of Foreign Affairs, the Estonian Ministry of Culture, as well as the Estonian Olympic Committee, and their clear advice was not to travel to Iran even for a sports event like the Davis Cup tie. ETA further referred to risks of terrorist attacks in Iran (as well as to the recent terrorist attacks). The ground for requesting the change of venue stemmed from section 29.2.5 of the Davis Cup Regulations, setting forth that the Davis Cup Committee has the right to decide that it is not possible or practicable for the opposing Nation to reach or play at the venue chosen for the Tie, due to (for example) an incident such as war, political unrest, terrorism or natural disaster.
