EKTK Women’s Leadership Club LEADELL at Pilv Law Office
On Friday, 17.01.2025, the Women’s Leadership Club of the Estonian Bar Association (EKTK) visited LEADELL Pilv Law Office and partner Pirkka-Marja Põldvere discussed with them about dispute resolution and related issues. Among other things, they talked about the point at which a dispute becomes a dispute, the considerations for going to (arbitration) court, whether or not to go to court, the need for a lawyer, the difference between a lawyer and an advocate, and the role of the parties and the courts in dispute resolution.
For example, Pirkka-Marja Põldvere, an experienced dispute resolution lawyer, pointed out that a large number of clients (including business representatives) underestimate the emotional burden of litigation over a number of years (e.g. reading in the other side’s document how they did everything wrong and were malicious in the first place, or answering the lawyer’s questions every now and then instead of doing their main work, not to mention the risk of the outcome of the dispute).
The difference between a tribunal and an arbitral tribunal was also briefly discussed, and that from 2024 the Estonian Chamber of Commerce and Industry Arbitration Tribunal will have updated rules.
