Clients of Jaak Siim found not guilty in facilitating benefit fraud
Partner Jaak Siim successfully represented the company OÜ Monoliit and its board member Jaak Reinmets in a criminal proceeding where the clients were accused of facilitating a benefit fraud.
The Prosecutor’s Office brought charges against NGO Vahuranna and its board members who planned to build a harbour with the financial support of the government agency Estonian Agricultural Registers and Information Board. Additionally, the constructors of the harbour – OÜ Monoliit as a legal person and Jaak Reinmets as a legal representative – were accused of facilitating a benefit fraud and knowingly assisting an illegal act of another person. According to the prosecution, in collaboration with the purchaser and implementer of works, the price of the investment object as well as the amount of own funds were indicated incorrectly. The grant in amount of over 170,000 euro was paid out for the construction of the first stage of the harbour.
Based on the 31.05.2019 court decision, all the accused persons were found not guilty. The state was also ordered to cover the procedural costs of the accused persons. Since the main act of crime has not been committed, any facilitation of the crime could neither take place – which was the content of accusation against the clients of LEADELL Pilv.
The court decision with reasoning shall be published on 26.06.2019 and can be appealed within 15 days thereafter.
