Article „Public hanging in media – acceptable or unacceptable?“ by Britta Oltjer and Tambet Laasik
On 5 April 2016 business daily Äripäev published the article „Public hanging in media – acceptable or unacceptable“ by attorneys-at-law Britta Oltjer and Tambet Laasik.
In the article, the authors are analysing the possibilities to limit the handling of such medical cases in media where patients are of opinion that doctor has been careless or made a mistake in their treatment. Patients have the constitutional right to decide if and to what extent they disclose information about their health to third persons, including general public. However, healthcare service providers do not have such privilege and they can disclose such information only upon the permission of the patient. In the article the authors are making a legal assessment regarding the limitations in publishing a conflict situation between patient and doctor, answering also the question „Can medical cases be published in media only after the end of investigation of the case?“
