Article „Is free WiFi network illegal from now on?“ by Ilmar-Erik Aavakivi
The Online portal of Eesti Päevaleht and Delfi have published the article „Is free WiFi network illegal from now on?“ by attorney-at-law Ilmar-Erik Aavakivi.
In the article the author is covering the recent decision Tobias McFadden vs Sony Music Entertainment Germany GmbH by the European Court. The court established that a precept can be made to a provider of free WiFi network to protect the network with password in order to enable the detection of network users at later stage. This measure should end or prevent the violation of copyrights and related rights. However, Ilmar-Erik Aavakivi does not agree with the opinion that soon the era of free WiFi will end or a network without protecting password can now be considered as illegal. At the same time the author admits that the referred court decision has created number of loose ends regarding the obligations of network providers.
The main conclusion resulting from the court decision is that in the future there will be less anonymous users in the Internet and more Online activities will be personalised.
