Aivar Pilv and Britta Oltjer successfully represented RIITO Ehituse AS in construction dispute
Senior Associates Aivar Pilv and Britta Oltjer of the LEADELL Pilv Law Office successfully represented construction company RIITO Ehituse AS in dispute resolution at the Harju County Court. In the referred dispute Riigi Kinnisvara AS filed a claim against RIITO Ehituse AS in amount over 1 million Euro.
After 6 years long proceeding, the County Court decided that constructor cannot be liable for the consequences resulting from faulty building design. The court established that in a situation where constructor has been constructing according to the design provided by the orderer and sufficiently checked by the sub-contractor who has also drawn attention to the faults, the sub-contractor cannot be responsible for the related consequences (for instance, extended deadline of works).
The judgment of the Harju County Court has not entered into force yet. Procedural parties have the right to appeal the decision within 30 days.
