Aivar Pilv and Anneli Aab successfully represented client in claim for compensation
Senior associates Aivar Pilv and Anneli Aab represented their client in court dispute with Zelluloosi Kinnisvara OÜ regarding a claim for compensation of damages against board member. Based on the 18.10.2017 decision of the Tallinn Circuit Court, the appeal of the Zelluloosi Kinnisvara OÜ remained unsatisfied and the decision of the Harju County Court was not changed. The value of the claim against our client for compensation of damages was 127,148.60 Euro and interests.
The dispute involved a member of management board who was allegedly influenced to perform a transaction harmful for the company by selling an apartment under its market value. The circuit court agreed with the standpoints of the county court failing to detect any illegal misuse of powers. Additionally the circuit court stated that the applicant failed to prove that the sale of the apartment would have damaged Zelluloosi Kinnisvara OÜ. Therefore the claim for compensation of damages against the alleged influencer as well as the beneficiary remained unsatisfied.
The decision can be appealed to the Supreme Court within 30 days.
