Attorney-at-law Raini Nõu accomplished a positive court decision for the client in a debt dispute
Attorney-at-law Raini Nõu successfully represented a client in civil court proceedings in a dispute where the question was whether the client (the defendant) was obligated to compensate the plaintiff for pecuniary damage because he did not return one technical device to the latter. The client performed various operations that was ordered by the plaintiff and issued an invoice to the plaintiff. The plaintiff however did not pay the invoice and did not want to accept the device. The plaintiff found that its pecuniary damage was the original value of the device in question. The court, relying on the facts, evidence and objections raised by the defendant, found that in the present case the defendant’s work should have been considered accepted by the plaintiff because the plaintiff was aware that the device was ready for delivery but did not accept it. By agreeing with the defendant’s arguments, the court took a position that there were no evidence that the plaintiff had requested for the deficiencies in the work to be remedied. By the court’s point of view, the defendant’s work was in accordance with the contract and the plaintiff did not file any claims. The court agreed with the client that it did not cause any damages to the plaintiff and that the plaintiff did not prove the damage in the court proceedings either. Therefore, by the Harju County Court’s decision, the lawsuit against the client was dismissed and the plaintiff was ordered to cover the client’s legal costs.
