Senior associates Anneli Aab and Aivar Pilv representing composer Ivar Must in claiming author’s remuneration
Senior associates Anneli Aab and Aivar Pilv of the LEADELL Pilv Law Office are representing in court dispute the Estonian composer Ivar Must who is claiming author’s remuneration from the company Põltsamaa Felix with regard to using the feature tune „Põltsamaa, ehtne ja hea“ in their ad campaigns for years without the consent of the author.
The dispute is resulting from the feature tune „Põltsamaa, ehtne ja hea“ which was composed for a juice advertisement already in 1994. Põltsamaa Felix has used the composition of Ivar Must without his consent for more than 20 years without paying any remuneration to the author.
An author has the sole right to use his or her work and determine the form and extent of use by others. The Copyright Act is also clearly establishing that an author has the right to obtain remuneration for the use of the author’s work by other persons. Furthermore, besides using the creation of Ivar Must during such a long period for business purposes without asking for the consent of the composer, neither has the author received any remuneration for the use of the feature tune „Põltsamaa, ehtne ja hea“ in numerous ad campaigns over the decades.
