Partner Jaak Siim successfully represented the client in court dispute regarding the obligation to pay agent fee
Attorney-at-law Jaak Siim of the LEADELL Pilv Law Office successfully represented in court the client who is providing services as real estate agent.
The dispute focused on the question whether the real estate agent had a right to claim agent fee from the defendant who made an apartment sale transaction with a person found by the agent but allegedly independently from the activities of the agent. Both the county court and circuit court stated that the right of claim of the agent was grounded. The courts were of opinion that it was meaningless if the agent contract had been terminated by the time when the person who had used the services of the real estate agent and the third person entered into the sale contract. The courts established that there were sufficient evidences to prove that the defendant concluded the sale contract of an apartment as a result of agent contract and therefore the real estate agent had the right to receive agent fee.
The defendant may appeal the judgment to the Estonian Supreme Court at the latest on 17 March 2017.
