LEADELL Pilv achieved successful results by representing Võru County Government in procurement proceeding
Võru County Government called for public procurement in order to conclude a contract for the provision of public bus transportation services. For various reasons it was impossible to start the contract on the prescribed date. Therefore the Võru County Government considered whether to extend the contract with previous provider of services SEBE AS or to conclude extraordinary direct agreement with Hansa Bussiliinid AS. The government decided to use the latter option and SEBE contested the decision in court.
The Tartu Administrative Court explained that extraordinary measures can be applied only in narrow situations as provided by law. The aim of the regulation for direct agreements is to allow the conclusion of a contract for public service without considering the clauses of equal treatment and protection of competition. The court was of opinion that in the given dispute such extraordinary circumstances occurred which justified the conclusion of direct agreement with Hansa Bussiliinid. Otherwise the provision of bus transportation in the Võru county might have stopped as from April 2016.
SEBE has the right to submit an appeal to the Tartu Circuit Court within 30 days.
