{"id":5875,"date":"2019-11-01T15:01:04","date_gmt":"2019-11-01T15:01:04","guid":{"rendered":"https:\/\/leadell.ee\/?p=5875\/"},"modified":"2019-11-01T15:01:04","modified_gmt":"2019-11-01T15:01:04","slug":"leadell-pilv-helped-shape-legal-practice","status":"publish","type":"post","link":"https:\/\/leadell.ee\/en\/leadell-pilv-helped-shape-legal-practice\/","title":{"rendered":"LEADELL Pilv helped to shape legal practice"},"content":{"rendered":"<p>LEADELL Pilv Law Office attorneys <a href=\"https:\/\/leadell.ee\/en\/attorneys\/anneli-aab\/\">Anneli Aab<\/a> and <a href=\"https:\/\/leadell.ee\/en\/attorneys\/aivar-pilv\/\">Aivar Pilv<\/a> successfully represented composer Ivar Must in a dispute against Orkla Eesti AS.<\/p>\n<p>The main question in the dispute was that did Orkla Eesti AS infringe Ivar Must\u2019s copyrights in its advertisement campaign ,,P\u00f5ltsamaa ehtne ja hea\u2019\u2019 <em>(P\u00f5ltsamaa real and good). <\/em>The county court found that the advertisements background sound which sounds through its verbal parts background contains merely occasional coincidences and similarities and does not infringe copyright. The circuit court however agreed with Ivar Must that Orkla Eesti AS in its advertisements ,,P\u00f5ltsamaa ehtne ja hea\u2019\u2019 has used authors 1994 original music audio edits without Ivar Must\u2019s permission and without any payment at least in the years 2013-2016.<\/p>\n<p>According to the circuit court\u2019s decision Orkla Eesti AS has infringed Ivar Must\u2019s copyrights, they can be reproached in breach of VAT liability and negligence and the court partially satisfied Ivar Must\u2019s monetary compensation claim.
