{"id":5865,"date":"2019-10-28T10:11:22","date_gmt":"2019-10-28T10:11:22","guid":{"rendered":"https:\/\/leadell.ee\/?p=5865\/"},"modified":"2019-10-30T10:12:11","modified_gmt":"2019-10-30T10:12:11","slug":"positive-judgement-aivar-pilvs-client","status":"publish","type":"post","link":"https:\/\/leadell.ee\/en\/positive-judgement-aivar-pilvs-client\/","title":{"rendered":"Positive judgement for Aivar Pilv\u2019s client"},"content":{"rendered":"<p>The circuit court did not change the former Tartu mayor Artjom Suvorov\u2019s positive decision.<\/p>\n<p>The court agreed with the defendant that crime imitators\u2019 actions were an unacceptable act of provocation.<\/p>\n<p>With Tartu Circuit Court\u2019s decision, the prosecutors appeal was dismissed and left Tartu County Court\u2019s 23<sup>rd<\/sup> of March 2019 decision unchanged, with what the former mayor of the city of Tartu, Artjom Suvorov was acquitted from the charges under the Penal Code sections 294 (2) subsections 1 &amp; 2, 209 (2) subsection 2 and 25 (1) (2) and Ivan Zayats from the charges under the Penal Code section 298 (1). In addition, circuit courts procedural costs for his contractual defendant attorney-at-law A. Pilv in total 4194 euros were ordered to be covered by the state.<\/p>\n<p>According to attorney-at-law A. Pilv what is important in this decision is that the court has pointed out general principles in the meaning between proving persons fault and presumption of innocence and thoroughly explained that why the charges against A. Suvorov were unproven. The defendant considers this to be particularly important in the situation where law enforcement authorities involved a crime imitator to the proceeding and the defendant brought out on the basis of the facts established that the acts of the imitator clearly went out of bounds of the limits set to staging a crime.
